Trump Asks High Court Clearance for National Guard Personnel in Chicago Area

On the end of the week, the government submitted an urgent appeal to the US supreme court, seeking authorization to send military reserve troops to Chicago and surrounding areas.

This action is part of a broader effort to increase the domestic use of the armed forces in a number of cities run by Democrats.

Judicial Challenge Over Guard Activation

In an urgent petition, the US Department of Justice asked the court to reverse a earlier court order that had blocked the sending of hundreds of state guard troops to the greater Chicago.

The presiding judge had raised doubts about the administration's reasoning for sending troops, doubting its explanation in considering the situation on the ground.

A higher court affirmed the previous order on the previous day, maintaining the stationing on standby while the court case proceeds.

Government's Justifications

The federal legal representative, speaking on behalf of the government, claimed in the new filing that federal agents have frequently been “intimidated and targeted” in the city of Chicago and the suburb of Broadview.

This area is home to an ICE detention center.

The commander-in-chief has previously deployed military reserve forces to the Windy City and Portland, after previous activations to Los Angeles, Memphis, Tennessee, and Washington DC.

The administration has argued that military intervention is needed to control demonstrations and strengthen immigration enforcement.

Ideological Pushback

Democratic officials have strongly opposed the move, saying that the president’s claims are inflated and politically motivated.

They charge the administration of misusing his power to punish opponents.

The judiciary have also expressed doubt about the administration’s depiction of ongoing incidents.

Regional authorities say that rallies over ICE activities have been mostly modest and calm, challenging the former president's description of “war zone” conditions.

Legal Basis

At the center of the conflict is the government's invocation of a federal statute allowing the president to federalize the military reserve only in cases of rebellion or when “incapable with the regular forces to enforce the statutes of the nation”.

The administration insists that the forces are required to defend government buildings and officers from activists.

Current Actions

Previously, the government federalized 300 troops of the Illinois military reserve and ordered additional Texas national guard forces into the state.

As state authorities condemned the move, the former president escalated his rhetoric, demanding the arrest of Chicago’s mayor and the governor of Illinois, both Democrats, charging them of not managing to secure ICE personnel.

The state of Illinois and municipal government filed a combined lawsuit the administration to halt the activation.

On October 9, the presiding federal judge, appointed by Joe Biden, delivered a temporary injunction blocking the command.

Meanwhile in Chicago, at least a dozen people were detained outside the ICE facility in Broadview following heated confrontations between local police and activists.
